<p>Both sides in the legal battle over healthcare have found reason to claim victory recently, but neither should pop open the champagne just yet, constitutional law experts said. Easy To Insure ME</p>
<p> A number of challenges to the individual mandate have been weaving their way through the legal system since the reform law was enacted, but a resolution is still far away.</p>
<p> </p>
<p>In the three district court cases that have been decided on their merits so far, supporters of the new law have a 2-1 edge.</p>
<p> Opponents of the new healthcare reform law were emboldened this week when a federal judge in Virginia ruled the law&#8217;s requirement that individuals purchase health insurance is unconstitutional.</p>
<p> Speaker-designate John Boehner (R-Ohio) used the ruling to go on the offensive, saying the Obama administration, instead of appealing the decision, &#8220;should work with Congress to repeal this job-killing health care law so we can replace it with reforms that lower costs and protect jobs.&#8221;</p>
<p> However, reform law supporters were the ones celebrating in November and October when federal judges in two cases upheld the individual mandate.</p>
<p> &#8220;Nobody&#8217;s really right,&#8221; said Gregory Magarian, a Washington University School of Law professor.</p>
<p> The Supreme Court will have the final word, and the district court challenges are hardly a predictor of how the Supreme Court will decide, experts said.</p>
<p> &#8220;We&#8217;re sitting at Round 1,&#8221; Magarian said. &#8220;To say anything about how this is going to shake out in the final reckoning is pretty much impossible.&#8221;</p>
<p> Reform law opponents say Congress cannot compel people to purchase health insurance against their will. Supporters say an individual&#8217;s refusal to purchase insurance is an active decision that can be regulated, because every person needs healthcare at some point.</p>
<p> The White House has been quick to claim victory on its blog when a lower court rules in their favor. So far, about a dozen cases against the reform law have been thrown out on standing, while the individual mandate has survived challenges in Virginia and Michigan in cases decided by Democrat-appointed judges.</p>
<p> Meanwhile, Virginia Attorney General Ken Cuccinelli claimed victory after a Republican-appointed federal judge in Virginia struck down the individual mandate Monday.</p>
<p> &#8220;Today, a federal judge in Richmond ruled the individual mandate of the federal health care law UNCONSTITUTIONAL!&#8221; Cuccinelli wrote on his website Monday. &#8220;In other words — we won!&#8221;</p>
<p> However, the district court rulings so far will have little bearing on how the law is implemented. The individual mandate provision doesn&#8217;t kick in until 2014, and experts don&#8217;t expect the Supreme Court to hear a challenge on the reform law until 2012 — the timing of which will certainly play a major role in the upcoming presidential election.</p>
<p> It is still uncertain how many challenges will reach the Supreme Court, as is how the justices will rule on the individual mandate. Only one district court case has reached an appellate court, and the Obama administration said it would appeal Monday&#8217;s decision. </p>
<p> The Supreme Court will ultimately decide whether to hear multiple challenges or single out one, since they all challenge the individual mandate on the same legal basis. A challenge in Florida, which was filed by 20 states and generated dozens of high-profile friend-of-the-court briefs, may be the most attractive case for the Supreme Court to hear, said Steve Schwinn, a constitutional law professor at John Marshall Law School.</p>
<p> &#8220;The Florida one is probably the most likely to get more attention because it does involve so many states coming on board to challenge the law, including attorney generals and governors,&#8221; Schwinn said.</p>
<p> However, trying to predict how the Supreme Court will decide on the constitutionality of the individual mandate is more difficult, he said.</p>
<p> &#8220;It&#8217;s such an odd kind of question, one that the Supreme Court hasn&#8217;t really touched on in an way that gives us an indication,&#8221; Schwinn said.</p>
<p> Though the Supreme Court will eventually decide on the law&#8217;s constitutionality, the appellate court can still play an influential role.</p>
<p> &#8220;The worst thing that could happen for the [Obama] administration,&#8221; Magarian said, &#8220;is a really resounding, well-reasoned appellate court opinion that strikes the healthcare program down, maybe on a number of related grounds.&#8221;</p>

			<content:encoded><![CDATA[<p><strong><strong> As the 111th Congress (2009-2010) comes to a close, it passed,</strong></strong> <strong><strong> and the President has signed,</strong></strong> <strong><strong>a tax bill with multiple moving parts</strong></strong>. The bill was part of an end-of-session deal forged by President Obama and Republicans, with little Democratic input. The bill preserves the Bush-era tax cuts (with no carve-out to tax millionaires), extends a number of otherwise expiring individual and business tax provisions, reinstates the estate tax on  Republican terms, and provides a 2 percent payroll tax cut for 2011 and a 13-month extension of unemployment benefits.  It remains to be seen whether this collection of legislative goodies will improve the public&#8217;s rather low (11 percent) approval rating of Congress, considering that it carries a $900 billion price tag that will be added to the national debt.</p>
<p><strong><strong>  Over the weekend, the Senate passed the repeal of the military&#8217;s &#8220;don&#8217;t ask, don&#8217;t tell&#8221; policy, which is now expected to be signed by the President this week. But</strong></strong> <strong><strong>Republicans in the Senate blocked Majority Leader Harry Reid&#8217;s effort to pass an omnibus appropriations bill for fiscal year 2011</strong></strong> (September 2010 to October 2011) because of the earmarks hanging on the bill. Consequently, Reid has pulled the bill and opted for a Continuing Resolution approach to keeping government afloat into the New Year.  With this funding measure fairly completed, the Senate and the House are likely to adjourn for good sometime this week.</p>
<p>  <strong><br /></strong></p>
<p><strong><strong> COLORADO: A draft bill regarding child-only coverage is being circulated. With an effective date of Jan. 1, 2012, the bill would require all carriers in the individual market, as of that date, to offer such coverage.</strong></strong> The bill includes two open enrollment periods, notice of availability on a carrier&#8217;s website and data reporting to the Commissioner on the number of applicants, enrollees and denials. Coverage may be denied if other creditable coverage is available, and a surcharge of up to 50 percent may be charged if a policy lapses for more than 63 days before an applicant seeks coverage again.</p>
<p><strong>  KANSAS</strong>: <strong><strong> Insurance Commissioner Sandy Praeger recently appeared before a public meeting of </strong></strong><strong><strong>Kansas&#8217; Joint Committee on Health Policy Oversight to give an overview of PPAC</strong></strong>A. Her presentation included Kansas-specific data on the uninsured population (18 percent), the newly established high-risk pool (currently 121 enrollees), reforms already in place, status of grant monies received, and plans for the future, including creation of an insurance exchange. Praeger explained that the federal government will take over creation of an exchange if the state declines to do so. Saying she &#8221;wants to make sure it is done right,&#8221; Praeger encouraged the legislators on the committee to move forward with implementation. While the committee members were in agreement that federal control of an exchange in    Kansas would not be desirable, they were also hesitant to support legislation that will enact anything related to &#8221;Obama-care.&#8221; They expressed concern about whether the federal government will actually provide funding to cover the costs and stated their preference for supporting a &#8220;repeal and replace&#8221; approach.</p>
<p><strong>  OKLAHOMA</strong>: <strong><strong> Members of the Oklahoma Association of Health Plans (including Aetna) recently met with Mike Rhoads, the incoming Deputy of Health Insurance, to talk about insurance exchanges and other topics</strong></strong>. Set to serve under Commissioner-elect John Doak, Rhoads is a former BlueCross BlueShield executive. Rhoads was very interested in input on the topic of exchanges, whether one should be created by the state, what it should look like and what flexibility the state would have in creating one. While the new Republican Congressional leadership is discouraging state officials from taking any action to implement PPACA, Rhoads explained that he and Commissioner-elect Doak prefer to make plans to implement what is currently the &#8220;law of the land&#8221; and take an active role in exchange creation. They would rather not allow the federal government to take over the exchange or waiting for the Supreme Court to finally decide the issue of constitutionality. He was very interested in feedback on the current state exchanges in operation in Utah and  Massachusetts, as well as any &#8220;models&#8221; that have been generated by working groups. Health plans also used the opportunity to discuss the topics of rate review, implementation of medical loss ratios (MLRs), the possibility of a phase-in for the individual market, and a new potential &#8220;pass through&#8221; fee on hospitals, intended to maximize federal Medicaid matching dollars.</p>
<p><strong>  TEXAS</strong>: <strong><strong> Last week, a historic super-majority of Republicans was created after two Democrat House members announced they were officially switching political parties</strong></strong>. Both members explained their decisions were due to political changes within their districts and a desire to &#8221;be what the majority of the district is now.&#8221; Republicans  now can pass constitutional amendments and legislation without seeking Democratic support. By having two-thirds of the votes, Republicans have the ability to suspend parliamentary rules and begin debate on partisan issues that Democrats were unwilling to even discuss in the past. Some of those issues include Immigration and Voter ID, which had previously been blocked by Democrats. The legislature goes back into session January 11, 2011.</p>

			<content:encoded><![CDATA[<p>Democrats&#8217; strategy for merging health care reform bills began to unravel under growing attacks Wednesday, including unexpected criticism from Colorado&#8217;s two Democratic senators.</p>
<p>Final negotiations on merging the bills began in earnest Wednesday as congressional leaders spent more than eight hours behind closed doors at the White House using a process that bypasses a formal conference committee and cuts out Republican participation.</p>
<p>They dug into a series of sticky issues that separate the two versions of the bill passed by the House and the Senate — including abortion, access to health insurance by illegal immigrants, and how to pay for the sweeping legislation, which will insure an estimated 37 million Americans over the next decade.</p>
<p>A White House statement said they had made &#8220;significant progress in bridging the remaining gaps&#8221; between the bills.</p>
<p>Republicans have been howling about the process for nearly two weeks — House Minority Leader John Boehner, R-Ohio, called it &#8220;a breeding ground for more of the kickbacks&#8221; — but now congressional leaders are facing a growing mutiny within their own ranks.</p>
<p>Wednesday, Sen. Mark Udall, D-Colo., suggested the talks lacked transparency and called for televising final negotiations. Sen. Michael Bennet, D-Colo., also said final talks should be open to live cameras.</p>
<p>&#8220;I haven&#8217;t been in Washington long, but one thing I can tell you is this is one town that can use some fresh air, and some real transparency,&#8221; Bennet said. &#8220;The outcomes from the negotiations on the health care reform bill are far too important to be done behind closed doors.&#8221;</p>
<p>Those criticisms could create significant difficulties for efforts to finish the health care bill and move on to other legislation before the press of this year&#8217;s election cycle swamps Congress.</p>
<p>Media organizations and others have said televising final negotiations between the House and the Senate would be natural given the enormous potential impact of the legislation.</p>
<p>Instead, Democrats have created a process under which House and Senate leaders will hammer out key compromises, then send the retooled bill to both chambers.</p>
<p>Those negotiations are expected to go for days, if not weeks, and Democratic leaders have said a conference would only provide Republicans — only one of whom voted for the bills in either chamber — a new chance at obstruction.</p>
<p>&#8220;This non-conference conference was a bid to speed this up and bring it to an end. A conference committee seemed one more area where Republicans would attack the Democrats and liberals would get upset with leadership,&#8221; said Julian Zelizer, an expert on Congress at Princeton University.</p>
<p>&#8220;The problem is it looked bad. Republicans can use that to say health care is being rushed through and done behind closed door because Democrats want to hide something,&#8221; he said. &#8220;That&#8217;s why you&#8217;re seeing Democrats now getting nervous about the process as well.&#8221;</p>

<p>Prohibitions Against Lifetime Maximum Benefit Caps. Carriers providing group or individual coverage are prohibited from setting lifetime maximum limits on the dollar value of benefits and from setting unreasonable annual limits on the dollar value of benefits, effective six months after enactment.</p>
<p>National High Risk Pool. People with pre existing conditions who are uninsurable will be eligible for subsidized coverage through a national high risk pool, beginning 90 days after enactment.</p>
<p>Limits on Share of Private Premiums Insurers Spend on Non Medical Costs. New limits will be set for the percent of premiums that insurers can spend on non medical claim costs.</p>
<p>Annual Review of Health Premium Increases. Effective immediately, the HHS secretary and states will establish a new process for annual review of unreasonable insurance premium increases.</p>
<p>Elimination of Cost Sharing for Preventive Care in Medicare and Private Plans. In 2010, cost sharing for proven preventive care services is eliminated in both Medicare and private plans.</p>

			<content:encoded><![CDATA[<p>Every year, more than one million Americans earn a college degree. Graduation is exciting, but flipping your tassel also means taking on new challenges. One of them is deciding what to do about health insurance.</p>
<p>Traditionally, young adults could only remain on their parents&#8217; policy until they turned 23 or finished college. Fortunately, new laws have extended the coverage period all the way to age 26. This gives you ample time to find a job that offers benefits.</p>
<p>But what if you don&#8217;t have coverage through your parents to begin with? This is a predicament millions of recent grads are still facing. Yet going without insurance is risky, even when you&#8217;re young and healthy. And in most cases, it really isn&#8217;t necessary. In fact, there are lots of ways to find coverage while chasing that dream.</p>
<p>Find a part-time job with benefits</p>
<p>Some places offer health insurance to employees who work 20 or 30 hours a week. Waiting tables a few nights a week may be all you need to do to get coverage. If that&#8217;s not your bag, try working at a gym, coffee shop or hotel. If you scout around, some larger companies may also offer health insurance benefits to part-time employees.</p>
<p>Take out a short-term policy</p>
<p>A number of insurers offer temporary coverage to recent grads. These policies last about three to six months and have a variety of features:</p>
<p> * They can be tailored to your needs.<br /> * They are fairly inexpensive.<br /> * They&#8217;re easy to cancel.<br /> * Some can be renewed.<br /> * You have to apply before graduation.<br /> * Pre-existing conditions usually aren&#8217;t covered.</p>
<p>Even with those disadvantages, though, a short-term policy can still be helpful. If you&#8217;re within a few months of finding a job, it might just be all the coverage you need.</p>
<p>Get a policy with a high deductible</p>
<p>A high deductible health plan (HDHP) is often a good option. Premiums are much lower than for standard policies. You have to pay the first few thousand dollars in health costs yourself. But in a real emergency, it can come in handy. Once you&#8217;ve met your deductible, the insurance coverage will kick in. If you get really sick your medical expenses may run high, but you won&#8217;t have to declare bankruptcy over an illness. Young people are usually healthy and preventive care is almost always included in a HDHP at no additional cost.</p>
<p>Consider COBRA</p>
<p>Federal law also allows parents to keep children on their employer plan if they&#8217;re no longer eligible for group coverage. You can use COBRA for up to 36 months, but it&#8217;s expensive. For starters, you pay all of the coverage costs plus a 2 percent administrative fee. The employer does not contribute to the plan, which means it could cost you as much as several hundred dollars a month. There&#8217;s a time limit, too. You only have 60 days after dependent coverage ends to re-enroll.</p>
<p>COBRA does offer a major advantage, though. You get the full range of benefits and coverage. That means access to all network doctors and facilities. And when you take that into account, COBRA might not be a bad deal. Besides, there&#8217;s one option that&#8217;s can be costlier than paying for COBRA.</p>
<p>That&#8217;s having no insurance at all.</p>

			<content:encoded><![CDATA[<p>Debates over supplementation with enzymes and antioxidants get frequent press as nutritionists and scientists work to discover the complexities of our bodies on a cellular level. Recent studies have shown that there are specific benefits to some of these substances, especially Coenzyme Q10 supplementation. The many benefits of this dietary supplement include increased heart health, anti-aging benefits, and relief from other diseases that plague us, especially as we age. It is important to understand why this enzyme is important to us, which groups are at risk for deficiencies, and the recommended supplementation dosages.</p>
<p>Coenzyme Q10, also known as CoQ10, or by the scientific name of Ubiquinone, is a naturally occurring enzyme and antioxidant needed for energy in every cell of the body. This enzyme is used by the mitochondria of all human cells to produce adenosine triphosphate, otherwise known as ATP, which is the energy source for the cell. The cellular mitochondria play a key role in cell growth, cell death, and is implicated in the aging process. Without enough CoQ10, our cells languish just as we would without proper nutrition. The organs with the highest energy output are the liver, heart, and kidneys, so these vital organs will suffer the most if levels of CoQ10 are deficient. </p>
<p>Normal cells go through a process of oxidation as part of the life cycle of the cell. This degradation results in the release of free radicals, which can do harm to other cells in the body after their release. Antioxidants, such as CoQ10 work to reduce the amount of circulating free radicals caused by oxidation and many scientists believe that supplementation with antioxidants will slow this damaging aging cycle.</p>
<p>While the body naturally produces CoQ10, levels of production decrease when we are in our twenties. It is also found in many foods in varying quantities, but it is difficult to eat enough of these foods to reach the levels needed. Foods that contain the most of this substance include beef, pork or chicken livers or heart, and soybean, grapeseed, and some olive oils. It is estimated that most Americans get no more than 3 &#8211; 6 mg per day from their diet and the recommended supplemental dose of CoQ10 is between 30 mg and 120 mg per day.</p>
<p>There have been multiple studies measuring levels of Coenzyme Q10 in persons with coronary disease. The heart muscle requires large amounts of energy to beat more than 100,000 times every day and patients suffering from congestive heart failure have been found to have low levels of CoQ10. When given this supplement, they have a resulting improvement in heart function and an improvement in overall heart health. Similar type studies have been done showing improvement in patients with Parkinson&#8217;s Disease, Migraine headaches, and high blood pressure. Research is currently underway to determine if these enzyme supplements have a positive effect on cancer and cancer treatment side effects. </p>
<p>Since CoQ10 lowers blood sugar and blood pressure, supplements should not be taken without the advice of a physician if treated for Diabetes or high blood pressure. Since the enzyme is chemically similar to vitamin K, talk to the doctor before beginning supplementation if taking medications to prevent blood clotting. Also consult a physician if taking medications for depression or Parkinson&#8217;s disease, as there is some indication that CoQ10 can potentiate the effects of the medications that also work to increase dopamine in the brain.</p>
<p>The widely prescribed statin drugs used to lower cholesterol are known to decrease the levels of CoQ10 required for cellular functioning and overall health. Most of these drugs are being taken by older patients fearing the threat of cardiovascular damage and sroke related to atherosclerosis or hardening of the arteries. While it is optimal to reduce cholesterol levels, supplementation with Coenzyme Q10 should be undertaken to prevent additional cardiac complications.</p>

			<content:encoded><![CDATA[<p>Well we live in a busy world and we all have insane amounts of work to do and so little time. Time is something that we all need to manage better but to give you a break I am going to give you a checklist of major tips and tricks to further your health journey. If you can just keep to these simple ideas while you are going through the detoxification process then you will achieve so much!</p>
<p>Keep only health snacks in your kitchen like hummus, apples, nuts and carrots so that temptation can not derail you.<br />
Do not deny your hunger. If your stomach is calling out for food, make sure you eat something.<br />
If you have a bad day and you succumb to your temptations, DO NOT PUNISH YOURSELF! We all have our bad times and negative emotions will just release more hormones into your system and cause more waste.<br />
Try not to <a rel="nofollow" onclick="javascript:_gaq.push(['_trackPageview', '/outgoing/article_exit_link']);" href="http://www.biospark.com.au/100-steps/step-2-food-and-water-do-not-mix.html">drink water</a> and eat at the same time. Keeping them separate will increase nutrient absorption.<br />
Make sure you have good posture. Not only will it be beneficial to your spine, but your posture is directly connected with your self esteem. You are worthy of standing tall so keep your chin up!<br />
Chewing Gum (though good for your teeth) causes havoc to your stomach and intestines. Chewing sets off digestive reactions so only chew just before or after a meal. Otherwise try peppermint tea to freshen breath.<br />
Take time to listen to your own head. What negative thoughts are you piling on yourself every day. Gather energy to fight these! We don&#8217;t need this negativity poisoning our minds.<br />
While detoxing decrease your intake of the 9 temptations. They are: Margarine, Tomato/BBQ sauce, Coffee, Alcohol, Cigarettes, Sugary drinks, Wheat, Sweets and Dairy products.<br />
Keep a healthy balance in your life. Do not become obsessed with your weight or health.<br />

Come to terms with some of your hidden emotions. These can drive your bad habits.<br />
Make sure you exfoliate or use a body brush once a week.<br />

<p>So that is a quick summary tips and tricks for beginners. Remember it is the combination of all these things that is making a difference to your overall health. You should take about 3 months to get all of these steps into place and then you will be ready for the next section.</p>

			<content:encoded><![CDATA[<p>A city firefighter involved in an off-duty motorcycle crash in June was denied health insurance coverage for his injuries because the city&#8217;s health insurance required him to wear a helmet.</p>
<p>Lt. James Baker waited to see if the city council would accept a negotiated settlement this evening that would pay a reduced amount.</p>
<p>The Sebring City Council will meet at 6:30 p.m. today at 368 S. Commerce Ave. to vote on this and several other issues.</p>
<p>Baker suffered injuries from a motorcycle crash on U.S. 27 for which the medical claim came to about $86,000. He was airlifted to the Tampa General Hospital&#8217;s trauma center.</p>
<p>&#8220;I was out for a little less than two months,&#8221; said Baker. &#8220;I returned to full duty around the first of August 2009.&#8221;</p>
<p>Baker&#8217;s insurance claim was initially denied because a clause added to the city&#8217;s health insurance policy in 2005 on &#8220;activities of a hazardous nature,&#8221; excluded from coverage motor cycle accidents without helmets.</p>
<p>Baker claimed he would have been injured regardless of whether he wore a helmet, and thus the claim should be paid. He suffered mostly abdominal injuries and no head injuries, he said Monday.</p>
<p>In 1998 when he was hired, Baker said he received a copy of his insurance policy, and at time the exclusion clause was not there. He had no recollection of being notified that it was added, he added.</p>
<p>Had he known of the exclusion, he would have been wearing a helmet, he said.</p>
<p>At a city Health Insurance Committee meeting, City Clerk Kathy Haley said she was not sure if the notice of the added exclusions were handed out to city employees, the minutes of the meeting show.</p>
<p>Mayor George Hensley said a committee or an employee might consider different activities &#8220;hazardous.&#8221;<br />City Administrator Scott Noethlich agreed, but asked how one defined &#8220;hazardous.&#8221;</p>
<p>Representatives of the city&#8217;s health insurance administrator, Anchor Benefit, negotiated a settlement of $46,750, which they will have to pay.</p>
<p>At a special meeting held Feb. 25, the committee recommended that the council accept Anchor Benefit&#8217;s negotiated discount with the understanding that Baker pays his remaining out-of-pocket maximum for the year of $734.74 and a $745 fee to negotiate the claims.</p>
<p>The tentative agreement further concluded that the basis of the recommendation was that Baker did not receive any head injuries and that he would have been injured even if he was wearing a helmet at the time of the crash.</p>
<p>However, it remains up to the city council to approve the deal.</p>
<p>Hensley said Monday that representatives of Anchor Benefit consulting had advised that this exclusion is not usually found in insurance policies, and Hensley believed the city would probably take a closer look at it.</p>
<p>Baker has since stopped riding a motorcycle, citing his love for his wife and five children.</p>
<p>He said that his wife told him while he was still in Tampa General Hospital that she knew how much he loved riding a motorcycle and she would not ask him to stop.</p>
<p>&#8220;That was a hobby,&#8221; said Baker. &#8220;I was ready to give it up, not to put my family through that again.&#8221;</p>
<p>On July 1, 2000, Florida exempted adult motorcyclists and moped riders from wearing helmets provided they have $10 000 in medical insurance, according to Andreas Muller, in the April 2004, American Journal of Public Health.</p>
<p>Since then, Florida statutes have required motorcycle riders younger than 21 years to wear helmets.</p>
<p>The statute was signed into law by former Gov. Jeb Bush.</p>
<p>Before that Florida had a helmet law that required all riders to wear safety helmets.</p>
